The seller shall guarantee that the commodity is completely new and in conformity to all respects with the quality,specifications and performance as stipulated in this contract and the technical agreement.If the technical data of the goods supplied by the seller cannot reach buyer’s lowest requirements, i.e the quality of the goods under this contract must be at least the same as the quality of the same goods previously supplied, the seller shall take necessary measures at his own expenses,such as modifying design,replacing contract goods etc., in order to at least reach above-mentioned quality level or pay liquidated damage to the buyer at the request of the end-user and the buyer.This liquidated damage will be calculated according to the specified life time and practical life time proportionally.
